Regardless of the specificity of some apprentices in the implementation of redundancy programs, dismiss an apprentice before the end of the apprenticeship, inappropriate or no employment contract that limits the flexibility of the employer. This is a very high risk and often a grey area of labour law, but it should not necessarily prevent employers from recruiting apprentices, as this route has many benefits for both the employer and the apprentices. The Vocational Training Act (2008/19) and the Labour Code do not explicitly set the minimum and maximum age for apprenticeship. In 2019/2020, the amount of pay for apprentices seeking a CCP qualification ranges from 452.56 to 769.36 in the first year; €509.08 to €995.60 for the second year; and from €622.28 to €1,131.36 for the third year of apprenticeship. On the other hand, apprentices with apprenticeship contracts have more rights. If they make a mistake or break the contract, the employer cannot automatically interrupt the training. Under the law, an “authorized English apprenticeship contract” is considered a service contract that gives the apprentice only the legal protection enjoyed by ordinary workers. The rights of an apprentice under an apprenticeship contract were discussed above. The agreement must be signed by both the apprentice and the employer at the beginning of an apprenticeship in order to validate the individual employment agreements between the two parties. A laid-off apprentice may receive a higher salary than other workers in the same situation. Indeed, such a distinction reflects not only the shortfall in the apprenticeship contract, but also possible future income that they cannot make now. Initial apprenticeship vocational training (which results in CCP, DAP or DT qualifications) legally requires an alternation between work-based learning in a training company.
Article 29 of the Vocational Training Act 2008 states that “initial vocational training preparing learners for professional life takes place in turn, whether as part of an apprenticeship contract or an internship agreement (see Q5 and Q18/former Q22) “. As an incentive for the State, apprentices who pass the school year receive a training bonus of 130 euros per month for training leading to a CCP qualification and 150 euros per month for apprenticeship places leading to DAP or DT qualifications.
